CPC Brooklyn Community Services Public Charge Forum

December 11, 2019

Have you or someone you know mentioned the words "Public Charge" lately? While public charge is not a new immigration policy, recently, the current federal administration issued a policy revision. The new public charge policy significantly expands how "public charge" is determined. It not only adds additional public benefits to the determination, but also increases its scrutiny on other factors in the public charge test.

Likelihood to become a "public charge" is one of the many tests considered when determining an applicant for permanent residency or entry into the United States. On August 14th 2019,  the federal government published the new public charge ruling with an effective date of October 15th, 2019.

Since the announcement, multiple federal judges in New York, California, and Washington, have ruled the change to public charge unconstitutional and violated administrative procedure. As a result, the new public charge ruling did not go into effect on October 15th, 2019. This preliminary injunction is a win for our immigrant communities.

However, as this is only a preliminary injunction, it is extremely important for our community to learn the facts of the new public charge ruling. On Wednesday, December 11th, 2019, CPC Brooklyn Community Services will be hosting a Public Charge Forum. The forum will begin with a presentation on public charge and the additions to the new ruling. Following the presentation, there will be an opportunity to meet with an immigration attorney from Office for New Americans (ONA) or a Department of Justice (DOJ) Accredited Representative from Immigrant Justice Corps (IJC). These specialists will be able to answer general immigration questions related to public charge. For a more comprehensive immigration screening, we will be making appointments for community members to visit CPC Brooklyn Community Services.
